Consumers across the U.S. who received certain marketing text messages promoting Farmers Insurance products may qualify for a cash payment under a proposed class action settlement. The settlement resolves claims that the messages violated the Telephone Consumer Protection Act (TCPA). 

The lawsuit, Starling v. Farmers Insurance Exchange, et al., alleges that Farmers Insurance entities, through an affiliated insurance agency, sent unsolicited marketing text messages to consumers whose telephone numbers were registered on the National Do Not Call Registry. Farmers deny any wrongdoing, but the parties have agreed to settle the case.

What is the Lawsuit About?

Plaintiff Kimberly Starling filed the lawsuit against Farmers Insurance Exchange, Farmers Insurance Company, Inc., and Fire Insurance Exchange, alleging violations of the TCPA’s National Do Not Call Registry provisions. According to the complaint, Starling’s cellphone number had been registered on the National Do Not Call Registry since 2004, yet she allegedly received multiple marketing text messages promoting Farmers insurance products.

The lawsuit contends that Farmers’ agents sent telemarketing text messages to consumers whose phone numbers were listed on the National Do Not Call Registry, despite those consumers having registered their numbers to avoid such solicitations. The complaint seeks statutory damages available under the TCPA for affected consumers.

Farmers deny the allegations and maintain that it complied with applicable laws. 

Who is Included in the Settlement?

According to the settlement papers, the proposed settlement class includes:

The settlement covers individuals who received two or more marketing text messages promoting Farmers products or services between October 8, 2020, and the date of class certification within any 12-month period. Eligible recipients must have had a phone number listed on the National Do Not Call Registry for more than 30 days at the time of the messages, and the number must have been registered to an individual rather than a business.

Importantly, the settlement is limited to text messages placed by or on behalf of:

Todd Henderson Insurance Agency, Inc. or R. Todd Henderson.

Court filings state that approximately 8,039 consumers were identified as potential settlement class members.

How Much is the Settlement Worth?

Under the proposed settlement, Farmers will make available up to $2.875 million to fund:

  • Payments to eligible class members
  • Settlement administration costs
  • A service award to the class representative
  • Attorneys’ fees and litigation expenses

Eligible class members who submit valid claims are expected to receive up to $425 each, although the final amount may be reduced on a pro rata basis depending on the number of approved claims submitted.

Settlement Timeline

Court records show that the litigation involved class-wide discovery and mediation before retired U.S. District Judge Wayne Andersen on September 2, 2025. After additional arm’s-length negotiations, the parties executed a settlement agreement in January 2026.

The settlement was subsequently presented to the Circuit Court of St. Louis County, Missouri for preliminary approval.
