June TCPA Class Action Filings Dip Slightly as Overall 2026 Cases Remain Elevated
New filing data from TCPAWorld indicates that Telephone Consumer Protection Act (TCPA) class action litigation may be showing early signs of slowing, although overall filing volumes for 2026 remain significantly higher than last year.
According to the latest figures, June 2026 recorded 250 TCPA filings, including 191 class action lawsuits. During the same month in 2025, there were 257 total filings and 202 class action filings.
The June totals represent 11 fewer TCPA class actions than the previous year.
First Year-Over-Year Monthly Decline in 2026
Although the reduction is relatively small, it marks the first year-over-year monthly decline in TCPA filings reported during 2026.
Previous months this year had consistently recorded higher filing volumes than their corresponding months in 2025.
The latest figures may indicate that litigation activity is beginning to stabilize after several years of sustained growth. However, it remains unclear whether the June decline represents the beginning of a broader trend or simply reflects normal seasonal fluctuations in filing activity.
Mid-Year Filing Totals Continue to Rise
Despite the June decline, overall TCPA litigation remains elevated.
According to the data, 1,263 TCPA cases had been filed during the first half of 2026, compared with 1,052 cases during the same period in 2025.
That represents an increase of approximately 20% year over year, indicating that litigation activity remains above last year’s pace despite June’s moderation.
Possible Factors Behind the Slowdown
The data does not identify a definitive reason for the month-over-month change.
However, industry observers have suggested that uncertainty surrounding SMS-related regulatory requirements and evolving Do Not Call (DNC) litigation may have contributed to slower filing activity. Others note that seasonal litigation patterns could also explain the temporary decline.
Additional filing data in the coming months will provide a clearer indication of whether June represents a broader shift in TCPA litigation trends.
Top Plaintiff Filing Activity
The report also identified Gerald Lane as the nation’s most active TCPA plaintiff so far in 2026.
According to the filing data, Lane has represented 431 consumers in TCPA litigation during the year.
Looking Ahead
While June marked the first year-over-year decline in monthly TCPA filings during 2026, overall litigation volumes remain substantially above 2025 levels.
Future monthly filing data will help determine whether the June figures signal the beginning of a broader moderation in TCPA class action activity or reflect a temporary pause in an otherwise active litigation environment.
